UPDATE: CONSUMER PRODUCT SAFETY COMMISSION EXTENDS STAY OF ENFORCEMENT

Here is Steve Kahane, International Coatings' President, with the latest news from the CPSC in regards to Phthalate testing: UPDATE: CONSUMER PRODUCT SAFETY COMMISSION EXTENDS STAY OF ENFORCEMENT ON PHTHALATE TESTING AND ANNOUNCES THIRD PARTY LABORATORY ACCREDITATION REQUIREMENTS The Consumer Product Safety Commission (CPSC) announced on August 10th that the stay of enforcement of the phthalate testing and certification requirements of section 14 of the Consumer Product Safety Improvement Act (CPSIA) with respect to toys and child care articles will stay in effect until December 31, 2011. Previously the CPSC had indicated that the stay would be lifted once notice was sent out with the requirements for accreditation of third party laboratories (or as the CPSC calls them, conformity assessment bodies) to assess phthalate limits in children’s toys and child care articles.  That notice was sent out on August 10th.  But the CPSC, in that notice, indicated that the stay will not be lifted at this time. The CPSC plans to begin enforcing third party testing and certification requirements for products subject to the phthalates content limits if the products are manufactured on or after January 1, 2012.  (Under the CPSIA, the term ‘manufacturer’ includes anyone who manufactures or imports a product.) At the present time, the CPSC has not accredited any laboratories to perform phthalate testing pursuant to the requirements of the CPSIA.
